Abstract

ABSTRACT Title of Thesis : Behavioral Indicators of Psychological Incapacity As Basis for Marital Dissolution from the Supreme Court Reports Annotated (SCRA) Authors: Marian Añonuevo, Ma. Josefa Kristina Bautista, and Maryan Krstan Dimapilis Funding source/ cost: Family/ P18,000 Date Started: September 2005 Date Completed: March 2006 Objectives: This determined the Behavioral indicators of psychological incapacity as basis for marital dissolution from the Supreme Court Reports Annotated (SCRA). Specifically, this research sought answer to the particular questions. 1. What is the demographic profile of the respondents based on; 1.1 age, 1.2 length of marriage, 1.3 educational attainment, 1.4 socio-economic status, and 1.5 religious affiliation? 2. What are the behavioral indicators of psychological incapacity as revealed in the SCRA? 3. Is there a prevailing pattern of behavioral indicators as revealed in the SCRA? 4. What is then the concept of psychological incapacity as basis for marital dissolution? Scope and Limitation: This study was limited to 30 accessed annulment cases of the Supreme Court’s Reports Annotated from 1994 to 2004. The researchers’ main concern was to recognize the petitioners’ statements as to indicating the psychological incapacity of his or her spouse and to categorize them accordingly. This study focused on the specific indicators of psychological incapacity as ground for the annulment of 30 accessed annulment cases of the SCRA. The researchers considered the demographic profile of the respondents as part of assessing the indicators of psychological incapacity. However, the study did not intend to correlate the 30 cases to other cases of psychological incapacity and other grounds for annulment. Methodology: This study utilized a Descriptive Research Design using content analysis technique to identify the specific indicators of psychological incapacity from the 30 annulment cases of the SCRA (Supreme Court’s Reports Annotated) from the year 1993 to 2004.
